Bombay HC rules in Kangana’s favour over petition for hurting sentiments

Actress Kangana Ranaut has often found herself in controversies after her social media uploads. It was only a few months back when the actress took over her Twitter account. Ever since then, she has been expressing her thoughts fearlessly. While sometimes, they are appreciated by netizens, sometimes, she gets slammed for the same. A few days back, a petition was filed against the actress for hurting sentiments by her tweets on Maharashtra and the city’s government. Now, the Bombay high court has ruled in Kangana’s favour.

A petitioner named Ali Kaashif Khan Deshmukh accused Kangana of creating a rift between communities through her tweets. In his petition, Deshmukh stated that Kangana’s tweet on Maharashtra and the city’s government has been hurtful. Justices SS Shinde and MS Karnik heard the petition today and ruled in the actress’ favor.

Justices stated, “This petition needs to be converted into a Public Interest Litigation (PIL), otherwise many people will read newspapers and start coming to the court stating they are hurt. Constitutional right and constitutional remedy are different. This is a vague petition.”

Talking about Kangana having fundamental rights for expressing her thoughts, Justice Shinde stated, “Any individual can have this account. She also has the fundamental right to have an account to express her thoughts. So, you have to show how your fundamental rights are breached. Unless the case comes under the reasonable restrictions, can we accede to your request? If you have to judge what will you do?”
